CONDITIONS OF SALE …..
PLEASE READ BEFORE MAKING PURCHASES

| 1. |
Bidders will register and obtain a bidder’s
number to be used at the auction. |
| 2. |
On the auctioneer’s call of
“sold” the highest bidder will be the purchaser. In the
event of any dispute between two bidders or in the event of doubt
on our part as to the validity of any bid, the auctioneer will have
the final discretion to determine either the successful bidder or
put the issues on the block and re-sell it. If any dispute arises
after the sales, Star of Texas Auction’s sale record shall be
conclusive as to who was the purchaser, the amount of the highest
bid, and all other respects. |

All property is sold as is, where
is Star of Texas Auction makes NO guarantees, warranties or representation
expressed or implied and waives any expressed or implied warranties
and representation with respect to the property or the corrections
of the catalogue, or the description of the authenticity, authorship,
physical condition, size quality, rarity, importation, provenance
or otherwise. Star of Texas Auction makes no guarantees, warranties
or representation as to any represented value, whether their market
otherwise. No statement anywhere, whether oral or written shall be
deemed such a guarantee, warranty or representation. Prospective bidders
are encouraged to inspect closely the property being sold prior to
bidding to determine its condition, size and value separate and distinct
from any representation by Star of Texas Auction personnel. |

While many items in the auction will
be sold without reserve, the auctioneer retains the right to bid in
behalf of each consignor for the purpose of processing reserves, that
is, to place bids during the auction if and when the highest outstanding
bid is less than the reserve on the lot being offered. |
| 5. |
Payments must be made on the day of
purchase. Cash, cashier’s check will be accepted. Checks must
be accompanied by a major credit card and a current driver’s
license. Parties unknown to Star of Texas Auction may be required
to provide further information and submit a deposit towards purchases
during the auction. |
| 6. |
On the auctioneer’s call of
“sold”, title will pass to the highest bidder, as acknowledged
by the auctioneer, subject to the bidder’s fulfillment of all
the conditions set forth herein. The bidder assumes full risk and
responsibility and agrees to pay the full purchase price. |
| 7. |
Star of Texas Auction is not responsible
for the acts or commissions of carries, delivery services or packers
of the purchased lots, whether or not recommended by us. Packing and
handling of purchased lots by Star of Texas Auction employees is the
entire risk of the purchaser and is no event will Star of Texas Auction
be liable for any damage to glass or frames, regardless of cause. |
| 8. |
This is a privately owned and operated
auction. We reserve the right to refuse admittance to any person for
any reason, or eject from the auction site anyone selling or attempting
to sell his or her merchandise or creating a distraction or disruption
during the auction. |
| 9. |
We reserve the right to withdraw any
item prior the auction without notice. |
| 10. |
If any of these conditions are not
complied with by the purchaser, in addition to the remedies available
to us and the consignor by law, including and without limitation the
right to hold the purchaser liable for the total purchase prices including
storage area. Star of Texas Auction will have the option to cancel
the sale, retain any deposit as liquidated damages, re-sell property
at our next auction with reserve, and hold the purchaser responsible
for any deficiency the original purchase price and storage fees and
sales commissions at our standard rates. A default purchaser will
be deemed to have granted as a security interest in, and we may retain
as collateral security for such purchaser’s obligations to us,
any property in our possession owned by such purchaser. We shall have
all the rights afforded a security party under the uniform commercial
code with respect to such property and we may apply against such obligations
all monies held or received by us for this account due from us for
the purchaser. Payment made and received is meant collected funds
at our basis only. |
| 11. |
In no event shall Star of Texas Auction
liability to purchaser ever exceed the purchase price actually paid. |
| 12. |
Unless special arrangements have been
made, all purchases must be removed from the premises within two days.
After the period, Star of Texas Auction will not be responsible for
lost or damaged merchandise and no refunds will be made if lost or
damaged. |
| 13. |
Neither the seller nor the auctioneer
assures responsibility for injuries suffered while inspecting or buying. |
| 14. |
Star of Texas Auction is not responsible
for any merchandise left at our location. |
| 15. |
All new issues guaranteed by the factory. |

10% BUYERS PREMIUM AND SALES TAX WILL APPLY TO ALL PURCHASES. |

ALL PURCHASES MUST BE PAID FOR TODAY. |
| 3. |
EVERYTHING SOLD AS IS, WHERE IS, NO WARRANTY,
NO GUARANTEE. |
| 4. |
CASH, CASHIER’S CHECKS, OR BANK LETTER ONLY.
A $300 CASH DEPOSIT IS REQUIRED WITH REGISTRATION AND IS FULLY REFUNDABLE
IF NO PURCHASE IS MADE DURING THE AUCTION. |
| 5. |
THE HIGHEST ACCEPTED BID SHALL BE THE PURCHASER. |
| 6. |
AUCTIONEERS NOT RESPONSIBLE FOR ERRORS OR OMISSIONS. |
| 7. |
ITEMS REMAINING AFTER THE DESIGNATED DAY OF SALE
ARE SUBJECTED TO A 2-DAY CHECK OUT CHARGE AND STORAGE FEE OF $30.00
PER DAY, PLUS COST OF PERSONNEL TO MEET IN LOCATION. |

DUE TO INSURANCE PURPOSES NO ONE UNDER AGE OF
